29 CFR  1926.453(b)(2)(iv): Aerial lifts. Specific requirements. Extensible and articulating boom platforms. Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.  a) On or about 08/03/2021, an employee was connect to an articulating boom platform, but working outside the basket, exposed to an above 25 ft. fall hazard while conducting roofing work.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a) On or about 08/03/2021 an employee was replacing an existing roof at a residential property.  Employee was wearing a harness but not attach to an anchor point. The height of the fall hazard was measured at above 25 ft. from the ground.

29 CFR 1926.454(a): Training requirements. The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: 1926.454(a)(1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area.   a) On or about 08/03/2021, employees were not trained to recognize fall hazards such as, but not limited to, an above 25 ft. fall hazard while operating an articulating boom platform nor was they trained on when to utilize a fall protection system.   An employee slide and fell of the roof, the height of the fall was measured at above 25 ft. from the ground.

29 CFR  1926.503(a)(1): Training requirements. The following training provisions supplement and clarity the requirements of 1926.21 regarding the hazards addressed in Subpart M of this part.  Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about 08/03/2021, employees have not been trained on fall protection systems and on hazards of falls, while working on top of roof at heights measured above 25 ft. from the ground.
