29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 26932 Spyglass Drive, Orange Beach FL; On or about August 13, 2021 and at times prior to the employer exposed employees to fall hazards in that employees were allowed to work on an elevated awning 10 feet from the ground level without first being protected by guardrail systems, safety net systems, or personal fall arrest systems.    b) Spyglass Condominium Complex, Orange Beach FL; On or about August 17, 2021 and at times prior to the employer exposed employees to fall hazards in that the employees were allowed to work on a roof that was 18 feet from the eave to the ground with a 6 on 12 pitch without first being protected by guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Spyglass Condominiums, Orange Beach; On or about August 17, 2021 employees were exposed to fall hazards in that roofing employees were allowed to ascend/descend a portable ladder to access the awning that was 10 feet from the eave to ground level without the ladder extending at least 3 feet above the eave of the roof.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  a) Spyglass Condominiums, Orange Beach; On or about August 13, 2021 and at times prior to the employer became aware of an incident where an employee fell off of a awning that was 10 feet from the eave to the ground resulting in a hospitalization of that employee due to severe head trauma.  The employer failed to notify OSHA within 24 hours.
