29 CFR  1926.503(a)(2)(iii):  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrails systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On August 18, 2021 at N2227 Hwy 73 in Wautoma, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than six feet while installing roofing materials.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On August 18, 2021 at N2227 Hwy 73 in Wautoma, Wisconsin, employees were working on a roof surface thirteen and one half feet above surface level without utilizing fall protection equipment.  The B Kottke Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1297786, citation number 01, item number 01a, and was affirmed as a final order on April 12, 2018, with respect to a workplace located at 137 / 139 5th Street; Fond du Lac, WI  54935.

29 CFR  1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On August 18, 2021 at N2227 Hwy 73 in Wautoma, Wisconsin, an employee was utilizing an extension ladder to access/egress a roof surface thirteen and one half feet above surface level without the side rails extended three feet above the roof edge.   The B Kottke Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1297786, citation number 01, item number 02, and was affirmed as a final order on April 12, 2018, with respect to a workplace located at 137 / 139 5th Street; Fond du Lac, WI  54935.
