29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Vicente Lopez at 509 West Cedar Street, Beresford, SD 57004:  On or about and at times prior to June 22, 2021 the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a 10/12 residential roof.  This condition exposed employees to fall hazards greater than 12 feet.

29 CFR  1926.502(d)(17):The attachment point of the body belt was not located in the center of the wearer's back. The attachment point of the body narness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:  (a)  Vicente Lopez at 509 West Cedar Street, Beresford, SD 57004:  On or about and at times prior to June 22, 2021 the exposing employer did not ensure that employees were utilizing fall protection systems as intended.  Employees were connecting the fall arrest systems to the side D-rings of the full body harnesses.  This condition exposed the employees to fall hazards greater than 12 feet and injuries associated with improper use of fall protection systems.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)  Vicente Lopez at 509 West Cedar Street, Beresford, SD 57004:  On or about and at times prior to June 22, 2021 the exposing employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees were engaged in roofing activities near the edge of the roof of a 10-in-12 pitch, residential home, without the use of a fall protection system or improperly utilized fall protection sytems. This condition exposed employees to fall hazards greater than 12 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart.  Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)  Vicente Lopez at 509 West Cedar Street, Beresford, SD 57004:  On or about and at times prior to June 22, 2021, the exposing employer did not ensure that each employee was protected from falls in that employees were utilizing ladders that were not extended at least three feet above the upper landing surface to gain access to the 10/12 residential roof .  This condition exposed employees to fall hazards greater than 12 feet.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  (a)  Vicente Lopez at 509 West Cedar Street, Beresford, SD 57004:  On or about and at times prior to June 22, 2021, the exposing employer did not ensure that each employee utilizing ladders had been trained to recognize the hazards associated with working with and on ladders. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The condition exposed employees to the hazard of falling from an elevation greater than 12 feet.
