29 CFR 1910.1200(e)(1): This standard is applicable to construction employment as defined by 1926.59: Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: The employer is failing to protect employees from chemical hazards while performing residential siding activities. This was most recently observed at 7224 172nd Street, Bennington, NE 68007, on August 17, 2021, where the employer has not developed a written hazard communication program for the employees working with chemicals. Chemical in use such as, but not limited to, VULKEM 116 sealant.

29 CFR 1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. The employer is failing to protect employees from fall and scaffolding collapse hazards while performing residential siding activities. This was most recently observed at 7224 172nd Street, Bennington, NE 68007, on August 17, 2021, where the employer has employees working on a pump jack scaffold. The employer had an employee erect the scaffold and the employee did not meet the definition of a competent person per the standard.
