29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor an alternative fall protection measure that meets a provision described in paragraph (b) of this section:  The employer is failing to protect employees from fall hazards.  On or about 8/17/2021, at 322 North A Street, Farmington, MO 63460, the employer did not ensure that each employee on a 12:12 pitch roof, approximately 22 feet above ground level, was protected from falling.  The employer failed to protect their employees by not providing one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems.

On or about 8/17/2021, at 322 North A Street, Farmington, MO 63460, the employer did not ensure that each employee on a 12:12 pitch roof, approximately 22 feet above ground level, was trained to recognized the hazards of falling and the procedures to be followed in order to minimize these hazards.  The employer failed to protect their employees by not providing fall protection training.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer is failing to protect employees from fall hazards.  On or about 8/17/2021, at 322 North A Street, Farmington, MO 63460, the employer did not ensure that each employee using a Werner Fiberglass Extension Ladder, MODEL: D6132-2, Electro-Master, Type 1A, 300lb capacity, and an Aluminum Extension Ladder (no marking) was installed properly to prevent a fall hazard.  The ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.
