29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a)  On or about 8/19/2021, on 270 East Avenue, at the 270 on East Apartments, located in Rochester, New York,  the employer did not enforce the use of a trench box or other protective systems to prevent cave-ins of the trench walls.  Employees were exposed to potential trench wall collapse during the excavation, where heavy equipment (excavator) was in use.  The employer allowed employees to get into the trench 6 feet deep without cave-in protection.  NO ABATEMENT CERTIFICATION REQUIRED
