29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).   On or about August 13, 2021, during the repair of a chimney of a residential home located at 3639 Cummings Rd, Cleveland Heights, OH 44118, the employer did not ensure an employee working from a Snorkelift Model TB- 42 P aerial lift utilized his lanyard by attaching to the work platform anchor point.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about August 13, 2021, during the repair of a chimney of a residential home located at 3639 Cummings Rd, Cleveland Heights, OH 44118, the employer did not ensure employees repairing a chimney were protected from a fall of approximately 10 feet by utilizing a fall protection system and did not provide any form of fall protection training or fall hazard recognition.

29 CFR  1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.   On or about August 13, 2021, during the repair of a chimney of a residential home located at 3639 Cummings Rd, Cleveland Heights, OH 44118, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1 as required. Employee were grinding out mortar joints of brick chimney with a handheld grinder that was not equipped with the following:  1. Commercially available shroud and dust collection system APF 10 APF 25;  2. Operate and maintain tool in accordance with manufacturer's instructions to minimize dust emissions;     3. and, Dust collector must provide 25 cubic feet per minute (cfm) or greater of airflow per inch of wheel diameter and have a filter with 99% or greater efficiency and a cyclonic pre-separator or filter-cleaning mechanism.

29 CFR  1926.1153(d)(2)(iii)(A):The employer did not sample the employee(s) who were expected to have the highest exposure to respirable crystalline silica:  On or about August 13, 2021, during the repair of a chimney of a residential home located at 3639 Cummings Rd, Cleveland Heights, OH 44118, the employer did not conduct initial silica sampling for job task and employees were engaged in grinding mortar joints on an existing chimney structure that contained silica. Employee(s) in direct breathing zone of Silica during grinding and at the potential highest levels of respirable silica dust.
