29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:   (a)On August 23, 2021, at the worksite located at 1618 Brentwood Dr. Round Lake Beach, IL., the employer did not implement any engineering controls, work practices, or respiratory protection specified in Table 1 of 1926.1153, when employees conducted asphalt cutting operations prior to the cutting the asphalt road.  No abatement documentation or certification required for this item.

29 CFR  1926.1153(d)(2)(iii)(A): The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area:   (a)On August 23, 2021, at the worksite located at 1618 Brentwood Dr. Round Lake Beach, IL., the employer did not assess the employee exposure to respirable crystalline silica when performing cutting operations using a Stihl TS700 14" Quick Cut Cut-Off Concrete Saw to cut the asphalt streets and driveways.   No abatement documentation or certification required for this item.
