29 CFR 1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. New townhome construction located on Lot #20 Snider Walk, Marietta, GA 30068, back side second level deck: On or about 08/23/2021, the employer exposed employees to fall hazards of approximately 14-feet, 2-inches to the lower level, in that a fall protection system was not provided to employees installing siding using a pump jack scaffold system.

29 CFR 1926.1153(c)(1): 29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1. New townhome construction located on Lot #20 Snider Walk, Marietta, GA 30068, rear side driveway: On or about 08/23/2021, the employer exposed employees to silica exposure while cutting James Hardie-Plank (Cemplank) siding, in that the Makita (Model 5007F) 7-1/4-inch circular saw was not equipped with a vacuum attachment as required by Table-1 for this task to limit the exposure to respirable crystalline silica.
