29 CFR  1926.451(a)(1):Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it.  On or about August 26, 2021 At this location, the employer instructed employees to use the welded tubular scaffold that was erected with missing parts exposing employees to fall hazards.

29 CFR  1926.451(b)(1):Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports.  On or about August 26, 2021 At this location, employees applying stucco exterior of building were instructed to work from scaffolding that was not fully planked exposing them to fall hazards.

29 CFR  1926.451(b)(2):Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.  On or about August 26, 2021  at this location the employer instructed employees to work from scaffold walkway that was not 18 inches wide to apply stucco to the exterior of the building exposing employees to fall hazards.

On or about August 26, 2021 At this location, a scaffold was erected and not evaluated by a competent person before allowing employees to use it and exposed employees to fall hazards.

29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  On or about August 26, 2021 At this worksite, employees worked on a scaffold to perform mason work.  The scaffold did not have a ladder installed and employees used the brackets to gain access and egress off the scaffold.  This exposed employees to fall hazards.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   On or about August 26, 2021 at this site employees were allowed to work from the welded tubular scaffolding to apply stucco to the building greater than 10 feet high without the use of a fall protection system exposing them to fall hazards.

29 CFR  1926.452(b)(2):Transverse bracing forming an "X" across the width of the scaffold shall be installed at the scaffold ends and at least at every third set of posts horizontally (measured from only one end) and every fourth runner vertically. Bracing shall extend diagonally from the inner or outer posts or runners upward to the next outer or inner posts or runners. Building ties shall be installed at the bearer levels between the transverse bracing and shall conform to the requirements of 1926.451(c)(1).  On or about August 26, 2021, employees worked on a scaffold that was incomplete.  Employees worked at heights greater than 10 feet on this scaffold doing mason work.  At the end of the scaffolding there was no transverse bracing and this exposed employees to falls from elevated heights.

29 CFR  1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  On or about August 26, 2021 At this worksite, the scaffolding used by the employees to apply stucco to the face of the building was not assembled  by a competent employee exposing employees to fall hazards.
