29 CFR  1910.502(c)(4)i: The employer did not conduct a workplace-specific hazard assessment to identify potential workplace hazards related to COVID-19.  a) AMITA Alexian Brothers Medical Center located at 800 Biesterfield Rd. in Elk Grove Village, IL 60007: On or about August 26, 2021, the employer did not conduct a hazard assessment for the Sterile Processing Department and failed to implement specific policies and procedures to minimize the risk of transmission of COVID-19 for employees working in the Sterile Processing Department.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.502(h)(1): The employer did not ensure that each employee was separated from all other people by at least 6 feet when indoors when such physical distancing was feasible.    a) AMITA Alexian Brothers Medical Center located at 800 Biesterfield Rd. in Elk Grove Village, IL 60007: On or about August 26, 2021, the employer failed to ensure that unvaccinated employees working in the Sterile Processing Department were separated from all other employees by at least 6 feet when indoors. Technicians spent in excess of 15 minutes per shift in close proximity (less than 6 feet) from other employees when working in the Assembly and Sterilization section of the Sterile Processing Department.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Healthcare workers did not wear a surgical, medical procedure, dental, or isolation mask that were FDA-cleared, authorized by an FDA EUA, or offered or distributed as described in an FDA enforcement policy when working inside the hospital. 29 CFR  1910.502(l)(5)(iii)(A): The employer did not pay the employee the same regular pay and benefits, up to $1,400 per week, until the employee met the return to work criteria specified in paragraph (l)(4)(iii) or (l)(6) of this section.  AMITA Alexian Brothers Medical Center located at 800 Biesterfield Rd. in Elk Grove Village, IL 60007: On or about August 26, 2021, the employer failed to pay Sterilization Processing Department (SPD) Technicians their same regular pay, up to $1,400 per week, when they were removed from work in accordance with paragraph (l)(4) of this section.   a) One SPD Technician was removed from work to quarantine on August 12, 2021, and returned to work on August 24, 2021. The Technician was not paid for the five days the employee was scheduled to work during that time period. The employee was owed $627.60.   b) A second SPD Technician was hospitalized between August 13 through August 15, 2021 and subsequently quarantined on August 15, 2021, and returned to work on August 31, 2021. The Technician was not paid for the ten days the employee was scheduled to work during that time period. The employee was owed $1,200.      No abatement certification or documentation is required for this item.
