29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:   (a) Hawthorne Ridge Inc. 30 Community Way, East Greenbush, N.Y.:  On or about 8/16/2021 and thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use.  The employer provided and required Registered Nurses, Resident Assistants, and Licensed Practical Nurses to wear N95 respirators while providing direct care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(f)(2):  The employer did not ensure that employees using tight fitting face piece respirators pass an appropriate qualitative or quantitative fit test prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  (a) Hawthorne Ridge Inc. 30 Community Way East Greenbush, N.Y.:  On or about 8/16/2021 and thereafter, the employer did not provide a fit test to all employees provided with, and required to wear, an N95 respirator.  The employer required Registered Nurses, Resident Assistants, and Licensed Practical Nurses to wear N95 respirators while providing direct care to suspected and confirmed positive COVID-19 residents.
