29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction, Lot 35, Roof: On or about 8/30/2021, the employer exposed an employee conducting framing activities to struck-by hazards, in that he was operating a Metabo NR83A5 framing nail gun at 120 PSI without eye protection.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, Lot 35, Roof: On or about 8/30/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second story. The employees were installing trusses at heights measured at 20 feet 2 inches to the lower level. Martin Dominguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(13), which was contained in OSHA inspection number 1449335, citation number 1, item number 1 and was affirmed as a final order on 2/11/2020, with respect to a workplace located at 6728 Scarlet Way, Flowery Branch, GA. 30542.
