29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021, an employee was walking and working directly under ongoing bricklaying work and did not have head protection.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   a) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021, an employee was performing bricklaying work on the fifth tier of the fabricated frame scaffold approximately 25-feet above the ground. The platform the employee was working from was not fully planked.   b) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021, an employee was walking on third tier of the fabricated frame scaffold approximately 15-feet above the ground. The platform the employee was working from was not fully planked.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.  a) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021,  an employee was accessing the fourth tier of the fabricated frame scaffold approximately 20-feet above the ground by climbing on the end frames and cross bracing.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.451(g)(1)(vi):Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  a) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021, employees were doing bricklaying work on the third tier of the fabricated frame scaffold, approximately 35-feet. above the ground below without a personal fall arrest systems or a guardrail system.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(h)(2)(ii):A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:Note:  This requirement does not apply to float (ship) scaffolds where an edging of 3/4 inch x 1 1/2 inch (2 x 4 cm) wood or equivalent was used in lieu of toeboards.  a) Worksite, 150 N Columbus Ave Freeport, New York 11520:  On or about August 31, 2021, employees worked from a fabricated frame scaffold approximately 35-feet above the ground while performing masonry activities which did not have toeboards erected along the edge of platforms to prevent ground level employees from being struck by overhead tools, materials and equipment.    Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
