29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) On or about September 1, 202,1 an employee was exposed to a head injury while throwing wood up to a co-worker in an aerial lift. The employer did not ensure the employee was protected from a head injury, by wearing protective helmet (hardhat).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift. As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) On or about September 1, 2021, an employee was used a JLG aerial lift (Model No. 400S & Serial No. 0300188834) to replace wood on the exterior of a commercial building. Employees were not protected from an approximate 7 1/2 foot fall/thrown hazard, by using a safety harness and lanyard attached to the lift.
