29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  On or about September 1, 2021, and at times prior thereto, an employee was installing shingles to the roof of the residential home under new construction up to approximately 18 feet high without fall protection training, exposing the employee to a fall hazard.

29 CFR  1926.1053(b)(1):29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  On or about September 1, 2021, two employees accessed the roof of a two-story home by using portable ladders that were not extended at least 3 feet above the upper landing surface, exposing the employees to a fall hazard of approximately 12 feet to the ground below.

29 CFR 1926.102(a)(1): Eye and face protective equipment was not used when machines or operations presented potential eye or face injury from physical agents:  On or about September 1, 2021, two employees were using pneumatic nail guns to secure shingles to a roof without wearing appropriate eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.  The Tunal Construction dba Antonio Tunal was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1282341 citation number 1, item number 2 and was affirmed as a final order on February 8, 2018, with respect to a workplace located at 520 Honeybird Lanenull Georgetown, TX 78626.

The Tunal Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1537888, citation number 02, item number 1 and was affirmed as a final order on 09/9/2021, with respect to a workplace located at Iris Glen And High Castlenull San Antonio, TX 78245.
