29 CFR 1926.353(c)(1):Welding, cutting or heating in an enclosed space involving the metals specified in this subparagraph, was performed without either general mechanical or local exhaust ventilation meeting the requirements of 29 CFR 1926.353(a). Amazon Fulfillment Center On or about August 23, 2021, subcontracted employees were exposed to hazardous metal fumes and gases when they were assigned to perform shielded metal arc welding using a Miller Trailblazer 325 EFI generator, often without mechanical or local exhaust ventilation, while welding steel bar joists, handrails, and stairs that contained chromium-bearing metals. The steel bar joists framed the ceiling on all floors and the handrails and stairs were welded in the stairway of levels one through five. Direct readings for levels of carbon monoxide that were taken while employees were welding in the stairway was measured between 40 and 60 ppm, exposing employees to asphyxiation hazards as a result of the gas accumulating in an enclosed area with no ventilation.

29 CFR 1910.1200(h)(2)(ii):The employer did not provide information to the employees on operations in their work area where hazardous chemicals were present: (Construction Reference: 1926.59) Amazon Fulfillment Center: On or about and sometimes prior to August 23, 2021, the employer did not ensure that subcontracted employers were informed of the hazardous chemicals including carbon monoxide (CO) that employees were generating and exposed to while performing tasks such as welding and sanding/buffing the floors with the use of generators that emitted CO gas.
