29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) New residential construction; Lot #26; right side: On or about 09/2/2018, the employer exposed employees who were installing Hardie Board siding to falls of 12-feet 5 inches to the lower level, in that a fall protection system was not provided to them while they were working from a pump jack scaffold.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction; Lot 26; Roof: On or about 9/2/2021, and at times prior, the employer exposed employees who were installing Hardie Board siding to fall hazards, in that a complete fall protection system was not provided to them while they were conducting the siding installation on a 10:12 pitched roof at heights measured at 16 feet 2 inches to the lower level.
