29 CFR 1926.501(b)(13):Each employee) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)Jason Liebel dba JL Construction at 701 North Main Street, Lennox, SD 57039: On or about and at times prior to September 7, 2021, the exposing employer did not ensure that employees were protected from falls by a fall protection system. Employees were installing roof trusses while standing on the exterior top plate during the construction of a single-family home without a fall protection system in place. This condition exposed employees to fall hazards greater than eight feet. (b)Jason Liebel dba JL Construction at 701 North Main Street, Lennox, SD 57039: On or about and at times prior to September 7, 2021, the exposing employer did not ensure that employees were protected from falls by a fall protection system. Employees were conducting framing operations on a residential property and exposed to fall hazards associated with an unguarded stairwell to the basement. This condition exposed employees to fall hazards greater than nine feet. Jason Liebel dba JL Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1441229, citation number 1, item number 2a, and was affirmed as a final order on March 10, 2020, with respect to a workplace located at 2300 North Lammers Avenue, Tea, SD 57064.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer: (a)Jason Liebel dba JL Construction at 701 North Main Street, Lennox, SD 57039: On or about and at times prior to September 7, 2021, the exposing employer did not ensure a written fall protection training certification record was prepared which included the identifies of employees trained, dates of training, and the signatures of the trainer or employer. Employees were engaged in framing operations over six feet involving the construction of a single-family home without the use of a fall protection system. This condition exposed an employees to fall hazards of approximately 8 to 9 feet. Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
