29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   a)  McCreery & Sun of Colorado, Inc., at 1700 18th Ave in Greeley, CO 80631:  On or about August 23, 2021,  and at times prior, the employer did not establish and implement a written program for the voluntary use of respiratory protection to ensure the respirators did not present a hazard to the user.   This condition exposed employees to physiological stress hazards.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:   a)  McCreery & Sun of Colorado, Inc., at 1700 18th Ave in Greeley, CO 80631:  On or about August 23, 2021, and at times prior,  the employer did not provide Appendix D of 29 CFR 1910.134 to employees who wear air purifying respirators for voluntary use.  This condition exposed employees to respiratory hazards in that employees were not provided with training or information  for the proper use and limitations of air purifying respirators.  At least two employees attempted to use air purifying respirators to control exposure to phosgene gas.  Phosgene gas requires the use of supplied air respirators.

29 CFR  1910.134(d)(1)(iii): When the employer was unable to identify or reasonably estimate the employee exposure, the employer did not consider the atmosphere to be IDLH:  a)  McCreery & Sun of Colorado, Inc., at 1700 18th Ave in Greeley, CO 80631:  On August 23, 2021,  the employer did not evaluate the exposure potential for phosgene gas while performing brazing operations on air-conditioning compressor unit that contained R-22 refrigerant.  This condition exposed two employees to inhalation exposure to phosgene without respiratory protection and/or engineering controls.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  a)  McCreery & Sun of Colorado, Inc., at 1700 18th Ave in Greeley, CO 80631:  On August 24, 2021, the employer did not report within 24 hours a work-related incident resulting in the hospitalization of two employees. Two employees were exposed to phosgene gas and were hospitalized.
