29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) At the facility, on or about September 8, 2021, the employer did not provide a hearing conservation program for an employee who was exposed to a time weighted average (TWA) of 92.1 decibels on the A scale (dBA) or an equivalent dose of 138.1% for a run time of 219 minutes, which exceeded the time weighted average of 85 dBA, thus exposing employees to the noise hazards.
