1926.100(a) Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. 29 CFR 1926.651(e): Employee was not prohibited to be underneath loads handled by lifting or digging equipment: a)Bayberry South - Stransky Avenue and Laughton Lane (South) Middletown Delaware: On or about 09/08/2021, the employer failed to ensure that employees engaged in excavation/trenching work did not work underneath loads that were being lifted and lowered into a trench 5'1" feet below grade. Excavator was located on the East side of the trench within 2 feet of the edge directly above an employee while the bucket was raised and lowered with the employee directly under it.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance paragraph (b) or (c) of 29 CFR 1926.652: a) Bayberry South - Stransky Avenue and Laughton Lane (South): On or about 09/08/2021, the employer failed to protect employees working in a trench with an adequate protective system when employees were required to enter and work in a trench where port ions of the excavation were unsupported including but not limited to the end where soil breached the work area which was improperly benched and did not have a proper protective shield in place.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and/ or other hazardous conditions: a) Bayberry South - Stransky Avenue and Laughton Lane (South): On or about 09/08/2021, the employer failed to inspect the conditions within the excavation. Employees engaged in excavation activities while installing a new sewer pipe connection to existing sewer infrastructure where no atmospheric testing was completed prior to entry into a trench approximately 5'1" feet deep and 10'5"feet wide.
