OSH ACT of 1970 Section (5)(a)(1):: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall and struck-by hazard(s) from riding the rear step of a refuse collection truck.   a) Roadway in front of 337 Henry Street, Scotch Plains, NJ - On or about 9/02/2021, an employee was exposed to hazard of falling from the rear step of a refuse collection truck as he rode the step during the 1.7 mile return trip to the company's yard. The vehicle was no longer engaged in route pick-up stops and was traveling at a speed in excess of 10 mph when the employee fell of the exterior step.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written chemical hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Maintenance Shop, A & S Sanitation Inc., 673 Jerusalem Road, Scotch Plains, NJ 07076;  On or about 9/09/2021 and thereafter, a written plan was not developed  for communicating hazard(s) of chemicals used be employee(s) for vehicle maintenance such as brake cleaner aerosol sprays and oxy-acetylene torch gas cylinders with flammable properties, as well as automotive lubricants & hydraulic fluids with simple skin/eye irritant properties.

29 CFR  1904.39(a)(1):The employer did not report within 8-hours the death of an employee resulting from a work-related incident.  a) On 9/02/2021, an employee of A & S Sanitation Inc. fell from the rear step of a refuse collection truck and died while it was traveling along Henry Street after completion of the day's collection route;  but did not report the death to OSHA. Notification of the workplace fatality was received from police six days later on 9/08/2021.  Condition(s) were noted on or about 9/09/2021.
