1910.146(c)(7)(iv): When hazards arose within a permit space that had been declassified to a non-permit space under 29 CFR 1910.146(c)(7), each employee in the space did not exit the space: a) Omnisource LLC located at 1500 Old Bowman Street Road Mansfield, OH, 44903: On or about September 9, 2021, the employer did not ensure a permit required confined space which had been declassified as a non-permit required confined space, was reevaluated once torching equipment was being used inside of the confined space. An employee performing maintenance work inside of the Harris Baler Model TG2102 baler, was using torching equipment to remove metal braces from underneath the ram, thereby creating a potential hazardous atmosphere inside of the confined space.

An employee was working on welding a baler ram of a Harris Baler Model TG 2102 where a lockout pin was removed resulting in the ram falling approximately 8 inches hitting the employee in the head and shoulder.
