OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were operating an equipment with no regular service and maintenance: On or about 9/7/2021, at the south section of a worksite located at 1901 Village Blvd., West Palm Beach, FL 33409, the employer permitted an employee to operate a boom lift truck, Model L36, in which the top drive upper cable was out of adjustment; the Adjust Studs & Jam Nuts (upper only) were in need of repair; and the Split Bearings were worn; thereby exposing employees to a fall hazard.

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift: IN THE ALTERNATIVE: 29 CFR 1910.140(d)(3): The employer did not ensure that body belts are not used as part of a personal fall arrest system. a) On or about 9/7/2021, at the south section of a worksite located at 1901 Village Blvd., West Palm Beach, FL 33409, an employee was permitted to wear a body belt as part of a personal fall protection system when operating a bucket truck during tree trimming operations, thereby exposing the employee to an estimated 10-foot fall hazard. b) On or about 9/7/2021, at the north section of a worksite located at 1901 Village Blvd., West Palm Beach, FL 33409, an employee was permitted to wear a body belt as part of a personal fall protection system when operating a Nifty SD34T articulating boom lift during tree trimming operations, thereby exposing the employee to an estimated 12-foot fall hazard.
