29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) Sandberg & Millers Design Group, LLC, at 2436 Gaylord Street, Denver, CO 80205:  On September 10, 2021 the exposing employer did not ensure that excavated materials were at least 2 feet from the edge of the excavation, in that a spoils pile situated on the east side of the excavation was an estimated 6 inches from the edge. Employees were required to work in the excavation measuring approximately 9 feet deep in the area beneath the spoils pile. This condition exposed the employee(s) to crushing and struck-by hazards.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions:  (a) Sandberg & Millers Design Group, LLC, at 2436 Gaylord Street, Denver, CO 80205:  On September 10, 2021, the exposing employer did not ensure that adequate and effective daily inspections of an excavation were conducted, in that employees worked inside an excavation that had nearly vertical sidewalls and was estimated 9 feet deep without an adequate protective system in place. A spoils pile situated on the east side of the excavation was approximately 6 inches from the edge of the excavation. This condition exposed the employees to crushing and cave-in hazards.

(a) Sandberg & Millers Design Group, LLC, at 2436 Gaylord Street, Denver, CO 80205: On September 10, 2021, the exposing employer did not ensure that employees working inside an excavation were protected from cave-in, in that employees worked in an estimated 9 feet deep excavation that had nearly vertical sidewalls without cave-in protection. This condition exposed employees to crushing and struck-by hazards.
