29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition). On or about September 10, 2021, and at times prior thereto, an employee performing flagger activities stood in the public roadway with oncoming traffic, exposing the employee to the hazard of being struck by a moving vehicle(s). The employer had not developed or implemented applicable elements of Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) for an employee working as a flagger at a construction site. Elements of the MUTCD not developed or implemented included, but were not limited to, the following: a) 6B.01: A Temporary Traffic Control (TTC) Plan was not prepared or implemented by all responsible parties before the site was occupied; b) 6E.07: The flagger stood in the lane being used by moving road users, as opposed to the road shoulder, before road users had stopped; c) 6F.31: Flaggers sign(s) were not used in advance of any point where a flagger was stationed to control road users.
