29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: a) Iron Worker Area: On or about September 09, 2021, and at times prior, the employer failed to take out of service a Clark Fork Truck (Model - CGP30 Serial No. : P365G-0737-9396FB) and required employees to perform forklift operations with damaged tires and hydraulic oil leaks; exposing employees to struck-by and crushed-by hazards during forklift operations. b) Weld Shop Area: On or about September 09, 2021, and at times prior, the employer failed to take out of service a Clark Fork Truck (Model - CGP30 Serial No. : P365L-0227-9396FB) and required employees to perform forklift operations with damaged tires; exposing employees to struck-by and crushed-by hazards during forklift operations. c) Weld Shop Area: On or about September 09, 2021, and at times prior, the employer failed to take out of service a American Eagle Fork Lift (Model - AE8112.02 Serial No. 5238A) and required employees to perform forklift operations with damaged tires; exposing employees to struck-by and crushed-by hazards during forklift operations. d) Trim Shop Area: On or about September 09, 2021, and at times prior, the employer failed to take out of service a Toyota Fork Lift Truck (Model - 7FGCU32 Serial No. : 66605) and required employees to perform forklift operations with damaged tires; exposing employees to struck-by and crushed-by hazards during forklift operations.
