29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) 7991 W. 71st Ave, Arvada CO 80004: On or about September 17, 2021, and at times prior, employees were not provided PPE (e.g. eye protection, hand protection, and clothing/splash protection apron) in the Aspen Neighborhood's oxygen room before transferring liquid oxygen from storage tanks to resident's oxygen tanks. The oxygen transfer room in the Aspen neighborhood did not have appropriate PPE available to employees for exposure to potential leaks from LOX tanks. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1910.132(f)(2):The employer did not require employees to demonstrate an understanding of the training specified in paragraph (f)(1) of this section, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE: (a) 7991 W. 71st Ave, Arvada CO 80004: On or about September 17, 2021, and at times prior, employees did not demonstrate an understanding of the ability to use PPE properly prior to transferring liquid oxygen from storage tanks to resident's oxygen tanks. Employees were not using provided PPE when transferring oxygen. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).
