Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  (a)  The employer did not report an employee amputation that occurred in the meat department on the Biro Model 3334 Serial # 52744 band saw on September 6, 2021, to OSHA until September 13, 2021.  The Kroger Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1299019, citation number 2, item number 1 and was affirmed as a final order on May 19, 2019, with respect to a workplace located at The Kroger Co. Store 430, Fairfield, OH.
