The employer failed to provide certification of abatement for two citations issued on December 30, 2021,  with citation 1-2b related to proving required fall protection safety training and citation 1-3b related to providing assessment for exposure to respirable crystalline silica and implementing safe work practices associated with the work task.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a)  On or about August 26, 2021 at 204 N 8th Street in Manitowoc, Wisconsin, employees were working from an eighth-floor roof surface removing brickwork from unprotected roof edges seventy feet above surface level without utilizing fall protection equipment.  b)  On or about August 26, 2021 at 204 N 8th Street in Manitowoc, Wisconsin, employees were working from a penthouse roof surface removing brickwork from unprotected roof edges twelve feet above a lower roof surface without utilizing fall protection equipment.

For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.   On or about August 26, 2021 at 204 N 8th Street in Manitowoc, Wisconsin, the employer did not ensure employees who were engaged in chipping and removing brickwork using hand held powered chisel tools from parapet walls were fully and properly implementing the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  Employees were operating rotary hammers with chisel attachments without a water delivery system, shroud and dust collection system, and without any respiratory protection.

Employees were operating powered chipping tools removing brickwork from roof parapet walls without fully and properly implement the engineering controls, work practices, and respiratory protection specified for the associated task on Table 1.
