29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:   (a)M3 Roofing and Construction, LLC at 1200 East 68th Street, Sioux Falls, SD 57104:   On or about and at times prior to September 14, 2021, the exposing employer did not ensure that employees conducting roofing activities were protected from fall hazards. Employees were working on the roof of a new single-family residence without a  fall protection system in place. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  (a)M3 Roofing and Construction, LLC at 1200 East 68th Street, Sioux Falls, SD 57104:  On or about and at times prior to September 14, 2021, the exposing employer did not ensure that employees engaged in roofing activities were trained to recognize the hazards of working at elevation and trained in the use of fall protection systems. Employees were engaged in re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 11 to 18 feet.    Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:     a)     The nature of fall hazards in the work area;  b)    The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  c)     The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)    The role of each employee in the safety monitoring system when this system is used;  e)     The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  f)     The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  g)    The role of employees in fall protection plans;  h)    The standards contained in this subpart.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet above the upper landing, and was not secured:    (a)M3 Roofing and Construction, LLC at 1200 East 68th Street, Sioux Falls, SD 57104: On or about and at times prior to September 14, 2021, the exposing employer did not ensure employees were protected from fall hazards associated with a portable extension ladder not extending 3 feet above the upper landing, and was not secured. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:   (a)M3 Roofing and Construction, LLC at 1200 East 68th Street, Sioux Falls, SD 57104:   On or about and at times prior to September 14, 2021,  the exposing employer did not ensure each employee was provided with a training program using ladders to train in the procedures to be followed to minimize hazards related to ladders. This condition exposed employees to a fall hazard while using an extension ladder to access and egress the roof.   Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:     (a)        The nature of fall hazards in the work area;     (b)        The correct procedures for erecting, maintaining, and disassembling the ladder being being used;     (c)        The proper construction, use, placement, and care in handling of all stairways and ladders;     (d)       The maximum intended load-carrying capacities of ladders; and     (e)        The standards contained in this subpart.
