29 CFR  1910.1200(h)(3): Employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv) (Construction Reference: 1926.59):  a) Historical Contracting & Restoration LLC temporary site located at 4900 South Broad Street, Philadelphia, PA 19112:  On or about September 16, 2021, the employer did not provide hazard communication training, including identification of chemical hazards, explanation of labels and safety data sheets, and measures employees can take to protect themselves from hazards related to chemicals used on site. Employees were exposed to lead contained in paint and other chemicals including nepheline syenite, titanium dioxide, and zinc oxide contained in Benjamin Moore Ultra Spec Ext Flat Finish Base 2 N4472X.

29 CFR  1926.62(d)(2)(v): Until the employer performed an employee exposure assessment as required under paragraph (d) of this section and determined actual employee exposure, the employer did not provide employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) of this section with interim protection:  a) Historical Contracting & Restoration LLC temporary site located at 4900 South Broad Street, Philadelphia, PA 19112:  On or about September 16, 2021,  in the absence of an employee exposure assessment, the employer did not provide employees with interim protection against lead, including but not limited to respiratory protection, personal protective clothing and equipment, change areas, hand washing facilities, and training. Employees were assigned to manually  scrape lead-based paint from the exterior of the building.
