29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Second Floor - Employees were preparing the second floor for exterior wood framed walls where fall protection was not provided and employees were exposed to a 13 foot fall hazard, on or about 09/16/2021.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Between First and Second Floors - Employees were using a job made ladder that was even with the second floor deck and used for access, exposing employees to a 9 foot fall, on or about 09/16/2021.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

Corner - Foreman was on a 6 foot portable step ladder that was used in the folded position while leaning up against an exterior corner, and talking with employees on the second deck, on or about 09/16/2021.  b) First Floor, S.E. Corner - Employee was standing on a 6' portable step ladder while cutting wood framing members over head and the ladder was leaning on interior wood framing in the folded position.  No abatement certification or documentation required for this item.
