29 CFR 1910.132(a):Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) On or about September 16, 2021, the employer did not ensure that protective equipment whenever hazards capable of causing injury and impairment were encountered. Employees of Alfredo Leon-Rodriguez, dba Rodriguez Tree Service were exposed to cuts and amputation hazards while conducting tree trimming activities using gas-powered chain saws. The workers were not wearing leather chaps to protect their extremities. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: (a) On or about September 16, 2021, the employer did not ensure that employees were wearing protective helmets when working in areas where there was a potential for injury to the head from falling objects. Employees of Alfredo Leon-Rodriguez, dba Rodriguez Tree Service were exposed to struck-by hazards while conducting tree trimming activities. The workers on the ground were not wearing protective helmets while branches and stumps were falling from overhead. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
