29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about September 16, 2021, and at times prior thereto, employees engaged in construction work on a 3-story building were working below other construction workers that were using hand-held tools and other construction materials without the use of a hard hat, exposing the employees to the hazard of being struck by falling tools, materials and debris from a higher level.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 16, 2021, and times prior thereto, employees were performing painting/plastering work on on a 3-story commercial building without the use of fall protection, exposing the employees to the hazard of falling up to approximately 15-feet and 25-feet to lower levels.
