OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about September 15, 2021, employees were exposed to struck-by hazards. One feasible method of abatement would be to ensure that subcontractors hired to maintain work zones use acceptable methods such as following Part 6 of the Manual of Uniform Traffic Control Devices (MUTCD) and ensure employees are trained in proper work methods to maintain maximum visibility such as using tools equipped with vacuums or water dispersing devices to reduce suspended dust particles

29 CFR 1926.200(g)(2): All traffic control signs or devices used for the protection of construction workers do not conform to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3 or Millennium Edition: (a) On or about September 15, 2021 at the jobsite where the employer allowed employees to work in a live traffic lane performing concrete cutting operations and not place temporary traffic barriers and pavement markings to separate the traveled way from the work zone to demarcate the live traffic lane from the adjacent work zone thereby exposing employees to the hazard of being struck-by errant vehicular traffic.

29 CFR 1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: (a) On or about September 15, 2021 the employer not determine if any employees performing concrete cutting operations may be exposed to respirable crystalline silica at or above the action level. Employees were assigned to utilize a STIHL handheld power saw to perform concrete cutting operations and employees were exposed to chemical inhalation hazards from respirable crystalline silica such as but limited to silicosis and lung cancer. The employer did not fully and properly implement the engineering controls, work practices, and respiratory protection described in Table 1-Specified Exposure Control Methods When Working With Materials Containing Crystalline Silica for employees performing concrete cutting operations with handheld power saws.
