29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: High Point Treatment Center Inc, 10 Kilburn Road, New Bedford, Massachusetts New Bedford TSS Center: On or about August 21, 2021, the employer did not develop and implement all elements of a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix) in that a written program was not developed, NIOSH approved respirators were not selected and used by all exposed employees, and a medical evaluation and fit test were not provided to employees prior to respirator use. There were employees that were required to wear N95 filtering facepiece respirators to protect against COVID-19 while providing care to positive COVID-19 residents.

There were employees including Recovery Specialists who were provided KN95 masks, which were not NIOSH approved and did not contain certification marking indicating they were certified under an equivalent international standard.
