29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about September 20, 2021, during the restoration of the barn doors located at 294 Pearl Rd, Brunswick, OH 44212, the employer did not ensure an employee working from a JLG Model 660JP aerial lift had the ability to recognize and avoid unsafe conditions. The employee was working inside the aerial lift basket, but could not operate the controls to maneuver the aerial lift. The employee did not have the ability to move the aerial lift basket in any direction.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. On or about September 20, 2021, during the restoration of the barn doors located at 294 Pearl Rd, Brunswick, OH 44212, the employer did not ensure an employee working from a JLG Model M600 JP aerial lift was wearing and utilizing a body belt (harness) and lanyard attached to the basket of the aerial lift.
