29 CFR  1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.   On or about September 20, 2021 on a worksite located at 40 Overlook Drive in Fond du Lac, Wisconsin, an employee was exposed to a fall hazard working from a 14 inch wide platform with unprotected edges at 27.5 feet above surface level.

29 CFR  1926.451(g)(1)(vii):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   On or about September 20, 2021 on a worksite located at 40 Overlook Drive in Fond du Lac, Wisconsin, an employee was working from a platform 27.5 feet above surface level without utilizing fall protection equipment which exposes the employee to a fall hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On or about September 20, 2021 on a construction site located at 40 Overlook Drive in Fond du Lac, Wisconsin, an employee was working from a wall top plate 27 feet above surface level without utilizing fall protection equipment which exposes the employee to a fall hazard.

29 CFR  1926.454(a)(1):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the nature of any electrical hazards, fall hazards, and falling object hazards in the work area.   On or about September 20, 2021 at a worksite located at 40 Overlook Drive in Fond du Lac, Wisconsin, the employer did not provide required scaffold safety training for an employee exposed to a fall hazard greater than ten feet while framing a three-story residential building from a work platform.

29 CFR  1926.503(b)(1):  Certification of Fall Protection training.  The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record.  The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   On or about September 20, 2021 on a worksite located at 40 Overlook Drive in Fond du Lac, Wisconsin, the employer did not maintain training certification for employees utilizing personal fall arrest systems and guardrails systems safety equipment for fall hazards greater than six feet.
