29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Arms Acres located at 75 Seminary Hill Rd. Carmel, NY - On or about September 2021 and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees including, but not limited to nurses, to wear N-95 filtering facepiece respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 patients.  b) Arms Acres located at 75 Seminary Hill Rd. Carmel, NY - On or about September 2021 and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees including, but not limited to nurses, to wear respirators while providing direct care to suspected and confirmed positive COVID-19 patients.  b) Arms Acres located at 75 Seminary Hill Rd. Carmel, NY - On or about September 2021 and thereafter, in the isolation room, the employer provided and required employees including, but not limited to nurses and maintenance employees, to use N-95 respirators and 3M 6200 half-face respirators with A1P2 combo cartridges. 29 CFR  1910.1030(c)(1)(i):The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:  a) Arms Acres located at 75 Seminary Hill Rd. Carmel, NY. - On or about November 23, 2021 and thereafter, employees including nursing, admissions, and maintenance staff handled sharps/needles as part of their jobs.   Admissions milieu staff have found needles and sharps in patient clothing.  Nurses administer medication and vaccines via needles.  Maintenance staff transported sharps containers to the garage where they were stored until pickup by a contractor.  The employer did not establish a written exposure control plan for bloodborne pathogens to eliminate or minimize employee exposure to blood or other potentially infectious material.
