Carmel, NY - On or about September 2021 and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees including, but not limited to nurses, to wear N-95 filtering facepiece respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 patients. b) Arms Acres located at 75 Seminary Hill Rd. Carmel, NY. - On or about November 23, 2021 and thereafter, employees including nursing, admissions, and maintenance staff handled sharps/needles as part of their jobs. Admissions milieu staff have found needles and sharps in patient clothing. Nurses administer medication and vaccines via needles. Maintenance staff transported sharps containers to the garage where they were stored until pickup by a contractor. The employer did not establish a written exposure control plan for bloodborne pathogens to eliminate or minimize employee exposure to blood or other potentially infectious material.
