1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: a) Lot 11, 12, 13, 14, 15, 16, 17, and 18 (multi-unit home) at the Lewes Crest development in Lewes, DE 19958: On or about September 21, 2021, the employer (GC) failed to ensure subcontractor's employees conducting framing and roofing operations work on a newly constructed multi-unit property, while being unprotected in all directions approximately 20 feet above grade, were provided adequate fall protection. Additionally, employees were working on balconies approximately 12 feet above grade without fall protection or guardrail system.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: a) Lot 11, 12, 13, 14, 15, 16, 17, and 18 (multi-unit home) at the Lewes Crest development in Lewes, DE 19958: On or about September 21, 2021, the employer (GC) failed to ensure subcontractor's employees used ladders that extended at least 3 feet above the upper landing to access the upper landings and roof, exposing them to fall hazards.
