29 CFR 1926.20(b)(2):  Accident prevention responsibilities:  Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.   On September 23, 2021 at a worksite located 343 Bell Street, Neenah, WI 54956; the employer did not provide for frequent and regular inspections of the job site and equipment used. Employees were exposed to fall hazards while working on a residential roof without fall protection and were exposed to eye hazards from flying particulate during pneumatic nailing without eye protection.

29 CFR 1926.503(a)(1):  The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   On September 23, 2021 at a worksite located 343 Bell Street, Neenah, WI 54956; the employer did not provide training to recognize the hazards of falling or the procedures to be followed in order to minimize those hazards for each employee exposed to fall hazards. Three employees installing roofing shingles on a residential building were exposed to falls from the roof approximately 9 feet above the lower level.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.   On September 23, 2021 at a worksite located 343 Bell Street, Neenah, WI 54956; the employer did not provide a training program for each employee using ladders. The employer did not provide training to three employees when they utilized extension ladders to conduct roofing work at the site. Employees were not trained to recognize hazards related to ladders or the procedures to minimize those hazards.

Employees were not wearing safety glasses or face shields when exposed to flying particles produced by the nail guns.

29 CFR 1926.501(b)(13):  Residential construction. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  On September 23, 2021 at a worksite located 343 Bell Street, Neenah, WI 54956; employees engaged in roofing activities on a residential home were working approximately 9 feet above the lower ground level and were not protected by guardrail systems, safety net systems or personal fall arrest systems.
