29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems: JOB SITE: 1135 Technology Drive in O Fallon, MO, on or about 9/19/2021, Ramos Drywall Specialist LLC employees were working at a residential building (new construction). An employee was unloading drywall compound from two pallets inside of a fabricated box attached to a JCB Telehandler, PIN # JCB5CG7GVL2931027 / Model 510.56 F. The employee was unloading from a fourth floor balcony. He was working without the proper use of guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training and as referenced by the note contained in 1926.602(d). JOB SITE: 1135 Technology Drive, O Fallon, MO 63368, on or about 9/19/2021, Ramos Drywall Specialists had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training. An incident occurred while an employee was operating a JCB Telehandler, PIN # JCB5CG7GVL2931027 / Model 510.56 F, to facilitate the unloading of drywall compound.
