29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)  Jobsite:  On or about September 27, 2021, an employee was working an an approximately 11 1/2 foot deep excavation with near vertical sidewalls and there was no shoring in the excavation.  The company was making a sewage tie in from a new building.

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)  Jobsite:  On or about September 27, 2021, the competent person entered and worked in an approximately 11.5 deep excavation knowing that the excavation should have been shored.   In addition, there were no soil tests done to determine the Class of soil that the employees were working with.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)  Jobsite:  On or about September 27, 2021, an employee was using an aluminum extension ladder to access/egress an 11 1/2 foot deep excavation and the top of the ladder only extended about 6 inches above the top of the excavation.

29 CFR  1926.1060(b):The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training:  (a)  Jobsite:  On or about September 27, 2021, an employee on the job needs to be retrained in  how to properly set up and use ladders.  The extension ladder used to enter the 11 1/2 foot deep excavation only extended about 6 inches above grade.
