29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Water tank, 12 Wing Road, Lynnfield, MA  a) On or about 9/27/21, an employee wearing a tight fitting elastomeric respirator in the workplace was not medically evaluated prior to the use of the respirator while conducting tank painting related tasks inside and around the water tank.

29 CFR  1910.146(f)(4):The entry permit that documented compliance and authorized entry to a permit space did not identify the authorized entrants within the permit space by name or by such other means (for example, through the use of rosters or tracking:  Water tank, 12 Wing Road, Lynnfield, MA  a) On or about 9/27/21, the entry permit for the permit space did not identify the authorized entrants working within the permit space by name or other means. By not identifying the entrants in the space, the employer would not know who or how many entrants are in the tank in the event of an emergency.  Or in the alternative:  29 CFR  1926.1206(d): The confined space entry permit did not list the authorized entrants within the permit space, by name or by such other means (for example, through use of rosters or tracking systems) as will enable the attendant to determine quickly and accurately, for the duration of the permit, which authorized entrants are inside the permit space;  Water tank, 12 Wing Road, Lynnfield, MA  a) On or about 9/27/21, the entry permit for the permit space did not identify the authorized entrants working within the permit space by name or other means. By not identifying the entrants in the space, the employer would not know who or how many entrants are in the tank in the event of an emergency.

In the alternative;   29 CFR  1926.1206(l):The entry permit did not identify rescue and emergency services that can be summoned and the means (such as the equipment to use and the numbers to call) for summoning those services:   Water tank, 12 Wing Road, Watertown, MA  a) On or about 9/27/21, the employer did not identify rescue and emergency services that would be summoned to rescue employees from the confined space in the event of an emergency.

29 CFR  1910.146(f)(8): The entry permit that documented compliance and authorized entry to a permit space did not identify the measures used to isolate the permit space and to eliminate or control permit space hazards before entry:  Water tank, 12 Wing Road, Lynnfield, MA  a) On or about 9/27/21, employees were not provided with the means, procedures, and practices to conduct safe permit entry, in that the employer did not indicate the need to monitor the atmosphere when the generator was running, or how to ensure that water would not re-enter the space during entry.  Or in the alternative;   29 CFR  1926.1204(c)(1):The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations by specifying acceptable entry conditions:  Water tank, 12 Wing Road, Lynnfield, MA  a) On or about 9/27/22, employees were not provided with the means, procedures, and practices to conduct safe permit entry, in that the employer did not indicate the need to monitor the atmosphere when the generator was running, or how to ensure that water would not re-enter the space during entry.
