OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, by being struck-by quartz slabs.   in that an employee worked in the fall shadow of a bundle of quartz slabs while a forklift operator retrieved the bundle with a forklift attachment clamp.  a. 4-24 Sellers St. Kearny, NJ  On or about 09/25/2021, Employees were exposed to working in the fall shadow of quartz slabs when the 1,400-pound slabs were being lifted and transported using a forklift and an Abco Little Giant lifter clam attachment.  Violation occurred on or about 09/25/2021

Caution shall be exercised when handling off-center loads which cannot be centered.  a. 4-24 Sellers St. Kearny, NJ  Employee (s) utilized an Abco Little Giant Lifter clamp connected to a forklift boom attachment to move quartz slabs weighting approximately 1,400 pounds. Employees used the clamp to lift multiple slabs at once, creating an unstable load and thereby exposing employees to struck-by hazards.   Violation occurred on or about 09/25/2021
