29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Skyline Construction, Inc. at 1312 East 70th Street North, Sioux Falls, SD 57104: On or about and at times prior to September 27, 2021, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were conducting re-roofing operations on a single-family residence without the use of a fall protection system. Subcontractor employees were also exposed to fall hazards associated with not erecting an extension ladder at least three feet above the roof. This condition exposed subcontractor employees to fall hazards of approximately than 10 feet.
