29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, 2009 Edition, December 2009 (including Revision 1 dated May 2012 and Revision 2 dated May 2012) - see 1926.6: a) Paving job for DELDOT - entirety of Lowes Road, Millsboro, DE 19966: On or about 9/28/2021, employees were exposed to multiple hazards onsite including but not limited to struck by/ caught in when the redirection of traffic from its normal path of travel to a new path did not happen. This placed employees in the direct path of on coming traffic on a high speed roadway within the work zone to perform site paving operations that did not direct the flow of traffic to prevent employee exposure to vehicular traffic according to Section 6C.05.

Employees and multiple vehicles were exposed to high speed vehicular traffic (50 mph) when the points of contact did not have the required taper and channelizing devices was not maintained according to Section 6C.08.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, 2009 Edition, December 2009 (including Revision 1 dated May 2012 and Revision 2 dated May 2012) - see 1926.6: a) Paving job for DELDOT - entirety of Lowes Road, Millsboro, DE 19966: On or about 9/28/2021, employees were exposed to multiple hazards onsite including but not limited to struck by/ caught in hazards when the employer failed to ensure employees were provided the required flagger stand set up within the work zone for paving operations with a lane closure. According to table 6E-1 of the MUTCD with the roadway speeds of 50 mph a flagger sign should be posted approximately 425 feet from the flagger stand allowing for adequate time to stop according to Section 6E.08.
